究竟美國聯邦最高法院大法官史都瓦特（已故）是怎麼說呢？他在專文”Or of the Press”(26, Hastings Law Journal, 1975)中，推論美國憲法對新聞自主制度（institutional autonomy of the press）有所保障，進而詳細論述。
美國習法的人，尤其是大法官，遣詞用字都十分的嚴謹。值得注意的是，史都瓦特談的是美國憲法對新聞自由的保障（constitutional guarantee of a free press），他說：to create a fourth institution outside the government as an additional check on the three official branches（在政府外創立一個第四機構作為三權的另一制衡）。而非說”to create a fourth institution within the government as an additional check on the other three official branches”（在政府內創立一個第四機構用以制衡其他三權）。
事實上，這篇文章是史都瓦特於一九七四年十一月二日在耶魯法學院一百五十週年紀念大會中的講詞，文中所一再強調的是，新聞自由不同於言論自由，新聞界有權利及特權或責任（the rights and privileges, or the responsibilities, of the organized press）。
